OVERVIEW
Welcome to Finiks Gravity.
Finiks Gravity is the trading name used for this online store. Finiks Gravity is not represented as a separately incorporated or registered company. The store is operated from Travesía Montevideo 2, 33720 Boal, Asturias, Spain.
Throughout these Terms of Service, the terms "Finiks Gravity", "we", "us" and "our" refer to the operator of the Finiks Gravity online store.
Finiks Gravity operates this website and online store, including the related information, content, features, tools, products and services made available through it (collectively, the "Services").
Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer products and Services to you. Purchases made through this store are transactions between you and Finiks Gravity and not between you and Shopify.
These Terms of Service, together with the policies referenced in them, govern your access to and use of the Services and purchases made through the store.
Please read these Terms of Service carefully before using our website or placing an order.
By accessing our website, using our Services or placing an order, you agree to these Terms of Service and the policies incorporated into them, subject always to any mandatory rights that apply to you under applicable consumer protection law.
Nothing in these Terms is intended to exclude, restrict or reduce any mandatory consumer rights that cannot legally be excluded or restricted.

SECTION 2 - ELIGIBILITY AND USE OF THE SERVICES
By using the Services, you confirm that you have the legal capacity required under the laws applicable to you to enter into a binding contract.
You agree to provide accurate, current and complete information when placing an order or creating an account.
You are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account, except where responsibility cannot legally be attributed to you.
You must not use the Services for unlawful, fraudulent or unauthorized purposes.
SECTION 3 - PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to describe and display our products accurately.
Product photographs, colors and other visual representations are provided for illustrative purposes. Colors and appearance may vary slightly depending on your device, screen settings, lighting, manufacturing variations and other factors.
Minor differences that do not affect the essential characteristics or conformity of a product may occur.
Product descriptions, availability and specifications may be updated when necessary.
We may discontinue products or limit their availability, subject to orders that have already created binding obligations and to applicable consumer law.
Nothing in this section limits your statutory rights where goods are faulty, damaged, incorrectly supplied or otherwise do not conform to the sales contract.
SECTION 4 - ORDERS AND CONTRACT FORMATION
When you submit an order, you are making an offer to purchase the selected products.
Receipt of an automated order acknowledgement does not necessarily mean that your order has been finally accepted.
An order becomes binding when we accept it in accordance with the checkout and order-confirmation process, subject to applicable law.
We reserve the right to reject or cancel an order where there is a legitimate reason to do so, including suspected fraud, payment failure, obvious pricing or product-information errors, inability to supply the product, or restrictions affecting the transaction.
If we cancel an order after payment has been collected, the amount due to you will be refunded using the original payment method where reasonably possible.
Customers must review their order details, delivery address and other information carefully before submitting an order.
Any cancellation or withdrawal rights available after ordering are governed by these Terms, our Refund Policy and applicable consumer law.
SECTION 5 - PRICES, CURRENCY, TAXES AND PAYMENT
The price payable for a product is the price displayed to the customer at checkout when the order is placed, subject to correction of obvious errors as permitted by applicable law.
Depending on the customer's location and the configuration of the store, prices may be displayed in different currencies, including EUR or CHF.
Any applicable taxes, delivery charges or other mandatory charges will be displayed as required before the customer completes the purchase.
Customers located in Switzerland who use TWINT must select an eligible checkout currency, including CHF where required for TWINT availability.
Available payment methods are displayed during checkout and may vary according to the customer's country, currency, order and payment-provider eligibility.
Payment information must be accurate, and the customer must be authorized to use the selected payment method.
Promotional prices, discount codes and special offers may be subject to separate conditions and availability.
SECTION 6 - SHIPPING AND DELIVERY
We deliver to destinations made available through our checkout.
Available shipping destinations, methods, estimated delivery periods and any applicable charges are displayed or communicated through the store.
Orders may require processing before dispatch.
Delivery dates and transit times displayed on the store are estimates unless a delivery date has expressly been agreed as binding.
Delays may occasionally occur because of carriers, customs procedures, severe weather, public authorities or other circumstances outside our reasonable control.
Nothing in this section removes or restricts a customer's statutory rights relating to delayed or failed delivery.
Where applicable consumer law requires delivery within a particular period, those statutory requirements continue to apply.
For consumer purchases, risk of accidental loss or damage remains with the seller until the goods are physically received by the customer or by a third party designated by the customer, except where applicable law provides otherwise, including certain circumstances where the customer independently appoints a carrier not offered by the seller.
Customers should provide a complete and accurate delivery address. Additional costs or problems caused by an incorrect address supplied by the customer may be the customer's responsibility where permitted by law.
SECTION 7 - RIGHT OF WITHDRAWAL FOR CONSUMERS
If you are a consumer and applicable European Union or European Economic Area consumer law applies to your purchase, you generally have a legal right to withdraw from a distance sales contract without giving a reason.
For most goods, the withdrawal period is 14 days from the day on which you, or a third party designated by you other than the carrier, physically receives the goods.
For an order containing multiple goods delivered separately, the withdrawal period generally begins when the last relevant item is received, where applicable under the law.
To exercise your right of withdrawal, you must communicate a clear statement of your decision to withdraw before the withdrawal period expires.
Withdrawal requests can be sent to:
support@finiksgravity.com
You may also use any withdrawal function or method made available on our website.
You do not have to provide a reason for exercising a statutory right of withdrawal.
SECTION 8 - EFFECTS OF WITHDRAWAL AND RETURNS
Where a valid statutory withdrawal is exercised, we will reimburse payments that we are legally required to reimburse, including the cost of the least expensive standard delivery method offered by us where required by applicable law.
If you selected a more expensive delivery method than our standard delivery option, additional delivery costs attributable to that choice do not have to be reimbursed where permitted by law.
Reimbursement will generally be made using the same payment method used for the original transaction unless otherwise agreed and permitted by law.
We will process statutory withdrawal reimbursements within the period required by applicable law.
For sales of goods, where legally permitted, we may withhold reimbursement until we have received the returned goods or you have provided evidence that the goods have been sent back, whichever occurs first.
Unless we have agreed to bear the return cost or applicable law requires us to do so, the customer is responsible for the direct cost of returning goods when exercising the ordinary 14-day right of withdrawal.
The customer must handle goods only to the extent necessary to establish their nature, characteristics and functioning, similar to the examination that would reasonably be possible in a physical shop.
The customer may be responsible for diminished value caused by handling beyond what is necessary for that purpose, to the extent permitted by applicable law.
These provisions concern the statutory right to change your mind. Different rules may apply where an item is faulty, damaged, incorrect or otherwise non-conforming.
SECTION 9 - EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The statutory right of withdrawal may not apply to certain products or contracts where an exception is provided by applicable law.
Depending on the circumstances, exceptions may include:
- Goods made to the consumer's specifications or clearly personalized.
- Goods liable to deteriorate or expire rapidly.
- Sealed goods that are not suitable for return for health-protection or hygiene reasons and that have been unsealed after delivery.
- Sealed audio recordings, sealed video recordings or sealed computer software that has been unsealed after delivery.
- Digital content not supplied on a tangible medium after performance has begun where all legal requirements for loss of the withdrawal right have been satisfied.
- Other goods or services specifically excluded from the statutory right of withdrawal under applicable law.
An exception will only be relied upon where the legal conditions for that exception are satisfied.
SECTION 10 - FAULTY, DAMAGED OR NON-CONFORMING PRODUCTS
Your statutory rights relating to faulty, damaged, incorrectly supplied or non-conforming products are separate from your ordinary right of withdrawal.
Consumers protected by EU consumer law have statutory rights concerning the conformity of goods, including the applicable legal guarantee provided by law.
Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction or termination of the contract and reimbursement.
Where the seller is legally responsible for non-conforming goods, the remedies required by law will be provided without improperly charging the consumer costs that must legally be borne by the seller.
Nothing in our Refund Policy, these Terms or any commercial warranty limits mandatory statutory rights.
SECTION 11 - REFUND POLICY
Our Refund Policy provides additional information about returns, refunds and the procedure for contacting us.
The Refund Policy forms part of the terms governing purchases from our store.
If there is a conflict between our Refund Policy and a mandatory consumer right, the mandatory consumer right takes precedence.
Customers can access the Refund Policy through the policy links provided on our storefront.
SECTION 12 - INTELLECTUAL PROPERTY
Unless otherwise stated, the website's original branding, design elements, text, graphics and other content created or lawfully licensed for Finiks Gravity are protected by applicable intellectual-property laws.
Third-party trademarks, product names, photographs, content and other intellectual property remain the property of their respective owners.
You may use the website for lawful personal purposes.
You must not reproduce, distribute, commercially exploit or otherwise use protected material from the website without authorization where authorization is legally required.
Nothing in these Terms transfers ownership of intellectual-property rights to you.
SECTION 13 - THIRD-PARTY SERVICES AND LINKS
Our Services may use or provide access to third-party services, payment providers, applications, websites or tools.
Third-party services may be governed by their own terms and privacy policies.
We are not responsible for third-party websites or services to the extent that responsibility properly belongs to those third parties.
However, the use of a third-party provider in fulfilling our obligations does not remove any responsibility that applicable consumer law places directly on us as the seller.
SECTION 14 - SHOPIFY
Our online store is powered by Shopify.
Shopify provides technology and infrastructure that enable us to operate the online store and process certain aspects of transactions.
The products offered through Finiks Gravity are sold by the operator of Finiks Gravity and not by Shopify, unless expressly stated otherwise.
Shopify may process information in connection with providing its services in accordance with its applicable terms and privacy practices.
Nothing in this section limits rights that a consumer may have against the seller under applicable law.
SECTION 15 - PRIVACY AND PERSONAL DATA
Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable data-protection law.
Our Privacy Policy is accessible through the policy links on our storefront.
Because our store is powered by Shopify and uses third-party service providers, certain personal information may be processed by Shopify and other service providers where necessary to provide the Services, process payments, fulfill orders, prevent fraud, provide customer support or meet legal obligations.
Please review our Privacy Policy for further information about how personal information is collected, used, shared and protected.
SECTION 16 - REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit a product review, feedback, suggestion or other content to us, you confirm that you have the right to submit that material.
You must not submit content that is unlawful, fraudulent, defamatory, infringing, malicious or otherwise violates the rights of another person.
To the extent necessary to display, reproduce and use content that you intentionally submit for publication, you grant us a non-exclusive license to use that content for operating and promoting the Services, subject to applicable law and our Privacy Policy.
Nothing in this section transfers rights beyond what is reasonably necessary for the stated purposes or overrides mandatory law.
SECTION 17 - ERRORS AND INACCURACIES
We make reasonable efforts to keep information on our website accurate.
Occasionally, information may contain typographical errors, technical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions, delivery information or other content.
We may correct errors and update information where permitted by law.
If an error materially affects an order that has already been placed, we will handle the matter in accordance with applicable contract and consumer law.
SECTION 18 - PROHIBITED USES
You must not use our website or Services:
- For unlawful or fraudulent purposes.
- To violate applicable laws or regulations.
- To infringe intellectual-property or other legal rights.
- To transmit malware, malicious code or harmful material.
- To interfere with the security or normal operation of the Services.
- To obtain unauthorized access to systems, accounts or information.
- To collect personal information unlawfully.
- To impersonate another person or misrepresent your identity.
- To engage in spam, phishing, fraud or other abusive activities.
- To circumvent technical measures designed to protect the website.
We may restrict or terminate access where reasonably necessary to protect the Services, our customers or our legal rights, subject to applicable law.
SECTION 19 - AUTOMATED SYSTEMS AND AGENTS
Automated systems, bots or software agents must not access or interact with the Services in a manner that violates applicable law, interferes with the website, circumvents security measures, misrepresents automated activity as human activity or imposes an unreasonable burden on our systems.
We may use reasonable technical measures to protect the website and Services against harmful or unauthorized automated access.
Nothing in this section is intended to prohibit activity that cannot lawfully be restricted.
SECTION 20 - AVAILABILITY OF THE WEBSITE
We aim to keep our website and Services available, but uninterrupted or error-free operation cannot be guaranteed.
Access may occasionally be interrupted for maintenance, security, technical failures, updates or circumstances outside our reasonable control.
We may modify website features where reasonably necessary.
Nothing in this section affects rights arising from a purchase contract or mandatory consumer law.
SECTION 21 - WARRANTIES AND STATUTORY RIGHTS
Information provided on the website is intended to assist customers in evaluating and purchasing products.
Nothing in these Terms excludes or limits any statutory guarantee, warranty, conformity right or other consumer protection that cannot legally be excluded or limited.
Any disclaimer appearing on our website applies only to the maximum extent permitted by applicable law.
Where mandatory consumer law provides greater protection than these Terms, the mandatory law applies.
SECTION 22 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
In particular, nothing in these Terms is intended to exclude or restrict mandatory liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot legally be excluded, or mandatory consumer rights.
To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable consequences of a breach or for losses arising from circumstances for which we are not legally responsible.
For consumers, nothing in this section removes remedies or compensation to which the consumer is entitled under mandatory law.
SECTION 23 - INDEMNITY
To the extent permitted by applicable law, you may be responsible for losses reasonably resulting from your unlawful use of the Services or intentional violation of these Terms.
Nothing in this section imposes obligations on a consumer that would be unfair, disproportionate or unenforceable under applicable consumer law.
SECTION 24 - TERMINATION OR SUSPENSION OF ACCESS
We may suspend or terminate access to the Services where reasonably necessary, including in cases of fraud, security threats, unlawful activity or serious violations of these Terms.
Termination of website access does not eliminate rights or obligations relating to orders already concluded, refunds due, statutory consumer rights or provisions that by their nature continue after termination.
SECTION 25 - SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be applied or limited to the extent permitted by law.
Where possible, the remaining provisions will continue in effect.
The invalidity of one provision does not automatically invalidate the remainder of these Terms.
SECTION 26 - NO WAIVER
If we do not immediately exercise a right or remedy available under these Terms or applicable law, this does not necessarily mean that the right or remedy has been waived.
SECTION 27 - GOVERNING LAW AND PLACE OF JURISDICTION
These Terms and contracts concluded through Finiks Gravity are governed by the laws of Spain, subject to any mandatory consumer-protection rules that apply to the customer.
Place of jurisdiction: Spain.
Where the customer is a consumer, nothing in these Terms deprives the customer of mandatory protections provided by the law of the country in which the customer habitually resides where those protections apply.
Any dispute will be submitted to the courts that have jurisdiction under applicable law.
Nothing in these Terms requires a consumer to bring proceedings exclusively in a court other than the court to which the consumer is entitled under mandatory applicable law.
SECTION 28 - CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our Services, business practices, technology or applicable legal requirements.
The version applicable to an order is generally the version in effect when the relevant contract is concluded, except where applicable law requires otherwise.
Material changes will be communicated where required by law.
The latest version will be made available through our website.
SECTION 29 - CUSTOMER'S RIGHT OF WITHDRAWAL
Consumers who qualify for a statutory right of withdrawal have the right to withdraw from eligible distance contracts within the applicable legal withdrawal period.
For most online purchases of goods covered by EU consumer law, this period is 14 days after the consumer, or a third party designated by the consumer other than the carrier, receives the goods.
No reason is required to exercise this statutory right.
To exercise the right of withdrawal, send a clear statement of your decision to:
support@finiksgravity.com
Please include sufficient information for us to identify the relevant order.
The detailed conditions, effects and exceptions relating to withdrawal are set out in Sections 7, 8 and 9 of these Terms and in our Refund Policy.
Nothing in these Terms restricts a statutory right of withdrawal where that right applies.
